This week we will elaborate a bit on &lt;a href="http://technorati.com/tag/premium+rated+sms+competitions" rel="tag" class="type1"&gt;premium rated SMS competitions&lt;/a&gt; in South Africa and how to go about the design of an acceptable competition, seeing that I am getting phone calls from interested parties wanting us to arrange such promotions/competitions.&lt;br /&gt;&lt;br /&gt;All WASPs (Wireless application service provider) belong to WASPA - the wireless application service provider association in South Africa.  WASPA has a &lt;a href="http://www.waspa.org.za/code/download/0079.pdf" class="type1" target="_blank"&gt;code of conduct&lt;/a&gt; (PDF) to which all members must adhere.&lt;br /&gt;&lt;br /&gt;So rules and regulations are in place when one look at the structure of the industry in South Africa.  &lt;br /&gt;&lt;br /&gt;Avoiding lotteries board investigation and or non-qualification when you run a competition is going to take some work when designing a promotion/competition.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Step 1: &lt;/strong&gt; &lt;br /&gt;Read the above code of conduct from WASPA.  Does the competition comply with the WASPA code of conduct?&lt;br /&gt;&lt;strong&gt;Step 2:&lt;/strong&gt;  &lt;br /&gt;Read and understand what is considered to be a lottery by the &lt;a href="http://www.nlb.org.za/pdf/Lotteries%20Act%2057.pdf" class="type1" target="_blank"&gt;lotteries act&lt;/a&gt;.  (you might need to consult a lawyer in this case)&lt;br /&gt;&lt;strong&gt;Step 3:&lt;/strong&gt;&lt;br /&gt;Ask yourself the following questions to define the nature of the promotion:&lt;br /&gt;&lt;ol&gt;&lt;br /&gt;&lt;li&gt;Is this an entry with the change of winning a prize? (Lottery) If yes, does it comply to any of the exceptions of the lotteries act? Example: charitable lottery run by an organization registered with the NLB.  If yes, case solved.  If no, please move on to the next point.&lt;/li&gt;&lt;br /&gt;&lt;li&gt;Is this a promotional competition?  I.e. is the core of the competition based on the sale of a product or service with the additional incentive to enter a competition by sending a SMS to a premium number?  If so, then yes, it is a valid promotional competition.  Sending a SMS to a premium number to win something is not considered to be a promotional competition as there is no product or service involved.&lt;/li&gt;&lt;br /&gt;&lt;li&gt;If the answer to no.2 is yes, then you should ask yourself what the cost of the entry is.  Verification and tracking services of entries into the competition could be charged for and that might be acceptable to work payment for services into the price of the entry fee.  Charging R 10 or R 30 per entry is however another story altogether. &lt;/li&gt;&lt;br /&gt;&lt;/ol&gt;&lt;br /&gt;The networks, at time of the release going to print, were not available for comment.  It will be interesting to see what the outcome of all of this would be.  Running a premium rated SMS competition is not as clear cut as in the past due to these factors coming into play. It uses GPS and works on Nextel and Sprint phones.&lt;br /&gt;&lt;br /&gt;BiM Active basically monitors activity through sound alerts.  When the athlete arrives back home, he/she could visit a web portal where their data could be uploaded and discussed with fellow athletes.&lt;br /&gt;&lt;br /&gt;At this stage it monitors the distance, speed/pace, location, elevation and calories burned during the activity logged - information collected could be viewed, shared and logged. After the following I am convinced that this war actually started and now the race is on for this market segment.&lt;br /&gt;&lt;br /&gt;Renewing a contract with the subsequent upgrading to a new handset is always fun as one have a new "toy" to explore.&lt;br /&gt;&lt;br /&gt;As part of my mobile phone contract, I recently upgraded my mobile phone to a Nokia 6680, which is G3 compatible and has some of the latest technologies available.  (I also needed this handset to play around with our bar code SMS where the handset acts as a scanner....) Browsing around exploring the latest features, I discovered that the default browser for the Nokia 6680 is Opera.....hmmm good move I thought and interesting development.  &lt;br /&gt;&lt;br /&gt;I also learned that Google made a deal with Opera to become the default search....&lt;br /&gt;&lt;br /&gt;On January 6, &lt;a href="http://www.google.com/intl/en/press/pressrel/motorola_mobile.html" class="type1" target="_blank"&gt;&lt;b&gt;Google&lt;/b&gt;&lt;/a&gt; announced an alliance with Motorola which will enable users easy access to Google via Motorola handsets.&lt;br /&gt;&lt;br /&gt;At the same time Yahoo launched &lt;a href="http://go.connect.yahoo.com/go" class="type1" target="-blank"&gt;&lt;b&gt;Yahoo!Go&lt;/b&gt;&lt;/a&gt; &lt;br /&gt;&lt;br /&gt;Yahoo!Go is a suite of products which allows users mail, messenger, address book photos and movies on their handsets.  It is a system where you could access all your information stored at Yahoo! through your mobile phone, laptop or TV.&lt;br /&gt;&lt;br /&gt;This facility is only available for the Nokia 60 series at this stage.  Network operators are still limited.  France, Germany, Italy, Spain, UK and some networks in the US are the only ones on the list at this stage. The service is limited to 7 networks in the US only at this stage.&lt;br /&gt;&lt;br /&gt;This news was received with mixed feelings and comments on Beatie's blog.  US residents felt that it might be just antoher way to swamp their inboxes - I think they forget that one have the choice to sign up or not.&lt;br /&gt;&lt;br /&gt;Another mystery to those that commented was how it was possible to do this for free.  Simple - revenue share.&lt;br /&gt;&lt;br /&gt;Some other comments included that it is not fair of Yahoo to launch this in the US only, but in response to that:&lt;br /&gt;&lt;ol&gt;&lt;br /&gt;&lt;li&gt;In the US subscribers pay for incoming and outgoing messages. They were disappointed with the South African market though as the subscriber base increased a mere 12% (8.9 million) in the last 6 months.  A loss in the prepaid market was also reported.&lt;br /&gt;&lt;br /&gt;Vodacom reported a 40% year-on-year growth to 15,8 million domestic customers.&lt;br /&gt;&lt;br /&gt;This implied that the non South African subscribers at MTN outstripped the local market.  56% of its customers are now residing in Nigeria, Cameroon, Cote d’Ivoire, Uganda, Rwanda, Swaziland or Zambia.&lt;br /&gt;&lt;br /&gt;SMS continued to dominate the data end of the business contributing 96% of total data revenue. This now gives Yahoo access to a worldwide fiber network.&lt;br /&gt;&lt;br /&gt;Are they just wanting to launch Yahoo in other countries or is there more to this than what we expect? Is Yahoo sending us a message that they are about to move totally into converged technologies?  Partnering with telco's that allows for worldwide fiber backbones are surely the way to go.
